For public performance venues, and in particular Cine Theaters, a Certificate of Static Suitability or CIS is of paramount importance.
This document, prepared by a licensed engineer with the professional register, typically an engineer, is mandatory. It certifies the goodness or otherwise of the structures of a building (the Cine Theater) precisely, which in case of disruption can have serious repercussions on public safety.
For the issuance of the necessary permits for public entertainment activities, the One-stop Shops of municipalities are required to acquire the relevant opinion on the fitness of the structure and facilities from the Supervisory Commission.
Duties of the Municipal Supervisory Commission.
The task of the Municipal Supervisory Commission is to verify the soundness and safety of the building to be used for public entertainment. In addition, it must verify the existence of exits fully suitable for promptly clearing it in case of fire, as indicated by Art. 80, Royal Decree no. 773/1931 T.U.L.P.S.-Testo Unico delle Leggi di Pubblica Sicurezza.
Specifically, the C.C.V. expresses the opinion of acceptability on plans for new premises to be used for public entertainment activities, variants of existing premises, and temporary event set-ups. Conducts periodic checks on the permanence of the general safety conditions of the facilities and places listed in Art. 1, Ministerial Decree Aug. 19, 1996 (with special reference to theaters, cine-theaters, cinemas and multiplexes, auditoriums and convention halls, dance halls, discos, etc.).
The Certificate of Static Suitability
Following intervening administrative simplification, with Legislative Decree no. 222 of November 25, 2016, substantial changes are made to the regulations to which premises, places and facilities used for public entertainment activities are subject. In particular, Art. 4 of the above decree (Simplification of administrative regimes in public security) stipulates that. the opinion within the competence of the Commission for the Supervision of Public Entertainment Premises, concerning “plans for new theaters and other premises or facilities for public entertainment and amusement, or substantial alterations to existing ones.”
With a capacity of 200 persons or less, shall be replaced
, subject to existing health provisions., by a technical report from a licensed professional, certifying that the room or facility complies with the technical regulations of the Minister of the Interior.
The Certificate of Static Suitability is not required when the building has Static Inspection issued at the time of its construction.
