On November 26, 2019, a new law on urban and spatial regeneration in Lombardy was passed.

Through it, urban and land regeneration interventions in brownfields will be facilitated and more cost-effective.

Therefore, Law 12/2005 is amended with a view to completing the regional strategy for reducing land consumption.

Urban and territorial regeneration: the new law in Lombardy

The law establishes incentives such as reductions in urbanization charges of up to 60 percent or volume-increasing bonuses of up to 20 percent that facilitate urban regeneration and rehabilitation of the built heritage.

These benefits are conditional on the improvement of buildings in all respects, including energy and safety.
In addition, the law introduces simplifications in procedures that speed up processes to identify, for example, regeneration areas, disused properties.

A fund is also to be established to finance regeneration interventions, feasibility studies and innovative financial instruments for public-private partnerships.

The goal of the interventions will be to rehabilitate individual houses or portions of neighborhoods with positive impacts on the habitability and attractiveness of urban centers .

The Law of Urban and Territorial Regeneration in Lombardy encourages the transformation of areas with new green spaces, services and infrastructure.

The projects will have to be within the provisions of spatial plans, complying with the already operating law on land consumption.

Municipalities will be responsible for creating an annual ‘census’ of abandoned or disused properties.

The Lombardy region will coordinate the operations

The role of the Lombardy region will be to coordinate the operations by delegating to municipalities the task of initiating the initiative, also on the recommendation of private individuals who will have to report particularly critical situations (dilapidated buildings that have been uninhabited for at least 5 years).

Private individuals who fail to proceed with the approved regeneration project that can solve safety or degradation problems will face criminal penalties or, in the most serious cases, expropriation.

In addition, the Law is also aimed at reducing bureaucracy and ensuring the timeframe for the implementation of interventions.

The budget law will initially allocate the sum of 2 million euros to promote censuses by municipalities.

Then it will continue with annual plans to which state and regional resources will also contribute.

Heritage Enhancement

According to the Lombardy region and Land and Civil Protection Councillor Pietro Foroni, this Law will have a disruptive and immediate effect on urban development.

Thanks to this law, rehabilitating the existing will become more profitable than building from scratch.

The 20% volume bonus on the built will be linked to the quality of the intervention, based on criteria established by resolutions of the Regional Council.
